W załączniku IX do rozporządzenia (WE) nr 1010/2009 dodaje się sekcje 4, 5 i 6 w brzmieniu:

„Sekcja 4

ISLANDIA

SYSTEM ŚWIADECTW POŁOWOWYCH

Zgodnie z art. 12 ust. 4 rozporządzenia Rady (WE) nr 1005/2008 świadectwo połowowe przewidziane w art. 12 i załączniku II do tego rozporządzenia zostaje z dniem 1 stycznia 2010 r. zastąpione – w odniesieniu do produktów rybołówstwa pochodzących z połowów dokonanych przez statki rybackie pływające pod banderą Islandii – przez islandzkie świadectwo połowowe bazujące na islandzkim systemie ważenia i rejestracji połowów, czyli elektronicznym systemie identyfikowalności, nad którym nadzór sprawują władze islandzkie, zapewniającym taki sam poziom kontroli przez właściwe organy, jakiego wymaga unijny system świadectw połowowych.

Wzór islandzkiego świadectwa połowowego przedstawiono w dodatku.

Dokumenty, o których mowa w art. 14 ust. 1 i 2 rozporządzenia (WE) nr 1005/2008, można przekazywać drogą elektroniczną.

Islandia wymaga świadectw połowowych w odniesieniu do wyładunków i przywozów do Islandii połowów dokonanych przez statki rybackie pływające pod banderą państwa członkowskiego Unii Europejskiej.

WZAJEMNA POMOC

W celu usprawnienia wymiany informacji i pomocy pomiędzy odpowiednimi organami w Islandii i państwach członkowskich Unii Europejskiej, w oparciu o szczegółowe zasady wzajemnej pomocy ustanowione w rozporządzeniu Komisji (WE) nr 1010/2009, rozwijana będzie wzajemna pomoc, o której mowa w art. 51 rozporządzenia (WE) nr 1005/2008.

KANADA

SYSTEM ŚWIADECTW POŁOWOWYCH

Zgodnie z art. 12 ust. 4 rozporządzenia Rady (WE) nr 1005/2008 świadectwo połowowe przewidziane w art. 12 i załączniku II do tego rozporządzenia zostaje zastąpione – w odniesieniu do produktów rybołówstwa pochodzących z połowów dokonanych przez statki rybackie pływające pod banderą Kanady – przez kanadyjskie świadectwa połowowe bazujące na kanadyjskim systemie świadectw połowowych (FCS) (opisanym w dodatku 3), czyli elektronicznym systemie identyfikowalności, nad którym nadzór sprawują władze kanadyjskie, zapewniającym taki sam poziom kontroli przez właściwe organy, jakiego wymaga unijny system świadectw połowowych.

Wzory kanadyjskich świadectw połowowych, które zastąpią świadectwo połowowe Wspólnoty Europejskiej oraz świadectwo powrotnego wywozu z dniem 1 stycznia 2010 r., przedstawiono w dodatkach 1 i 2.

Połowy przez grupy etniczne na potrzeby własne lub ze statków rybackich określonych w art. 6 rozporządzenia Komisji (WE) nr 1010/2009 dokumentowane są za pomocą uproszczonego kanadyjskiego świadectwa połowowego przedstawionego w dodatku 2.

Dokumenty, o których mowa w art. 14 ust. 1 i 2 rozporządzenia (WE) nr 1005/2008, można przekazywać drogą elektroniczną.

WZAJEMNA POMOC

W celu usprawnienia wymiany informacji i współpracy administracyjnej pomiędzy odpowiednimi właściwymi organami w Kanadzie i państwach członkowskich Unii Europejskiej, w oparciu o szczegółowe zasady wzajemnej pomocy ustanowione w rozporządzeniu (WE) nr 1010/2009, rozwijana będzie wzajemna pomoc, o której mowa w art. 51 rozporządzenia (WE) nr 1005/2008.

Dodatek 3

Kanadyjski system świadectw połowowych (FCS) przeznaczony jest do wydawania standardowych i uproszczonych świadectw połowowych.

FCS będzie służył do wydawania i zatwierdzania świadectw połowowych dla przesyłek konwencjonalnych produktów rybołówstwa wywożonych z Kanady do Unii Europejskiej, w tym żywych, świeżych, mrożonych, solonych, konserwowanych lub wędzonych i suszonych ryb, wykorzystujących surowce z połowów nieprowadzonych ze statków rybackich, połowów przez grupy etniczne na potrzeby własne lub połowów z małych i dużych statków rybackich lub zawierających produkty wytwarzane w ramach procesu produkcyjnego obejmującego kilka etapów.

Aby maksymalnie zwiększyć wydajność, Kanada będzie grupować niektóre statki na uproszczonych świadectwach połowowych. FCS zachowa jednak pełne dane statków wchodzących w skład grupy, a statki te będą dalej powiązane z informacjami na temat swoich licencji lub rejestracji i połowów zadeklarowanych na świadectwie.

Grupowanie będzie stosowane w odniesieniu do niektórych postaci produktów, a w szczególności w odniesieniu do połowów przy użyciu statków, które gromadzą ryby zakupione od różnych statków rybackich i wydają świadectwa sprzedaży na morzu, połowów nieprowadzonych ze statków rybackich przy użyciu niewodów dobrzeżnych, zbiorów małży na plażach, połowów pod lodem, dla niektórych rodzajów rybołówstwa przybrzeżnego, połowów przez grupy etniczne na potrzeby własne, jeśli mogą być one prowadzone w ramach społeczności lokalnej. Grupowanie będzie stosowane w odniesieniu do poszczególnych przedsiębiorstw wywozowych i w zależności od potrzeb będzie modyfikowane dla każdej wysyłki.

Grupowanie umożliwi Kanadzie wydawanie jednego świadectwa dla każdej wysyłki przy jednoczesnym zachowaniu wszystkich informacji dotyczących świadectwa (licencji/rejestracji statku) dostępnych w bazie danych.

Informacje te będą dostępne dla władz państw członkowskich UE w krajach przywozu za pośrednictwem naszej strony internetowej lub poprzez bezpośredni kontakt telefoniczny z naszym biurem certyfikacyjnym.

Kraje będące osobami trzecimi mogą również skontaktować się z biurem certyfikacyjnym w celu zasięgnięcia informacji na temat wywozu pośredniego.

Sekcja 6

Wyspy Owcze

SYSTEM ŚWIADECTW POŁOWOWYCH

Zgodnie z art. 12 ust. 4 rozporządzenia Rady (WE) nr 1005/2008 świadectwo połowowe przewidziane w art. 12 i załączniku II do tego rozporządzenia zostaje zastąpione – w odniesieniu do produktów rybołówstwa pochodzących z połowów dokonanych przez statki rybackie pływające pod banderą Wysp Owczych – przez farerskie świadectwo połowowe bazujące na farerskim systemie not sprzedażowych i dzienników połowowych, czyli systemie identyfikowalności, nad którym nadzór sprawują władze Wysp Owczych, zapewniającym taki sam poziom kontroli przez właściwe organy, jakiego wymaga unijny system świadectw połowowych.

Wzór farerskiego świadectwa połowowego, które zastępuje świadectwa połowowe Wspólnoty Europejskiej oraz świadectwo powrotnego wywozu z dniem 1 stycznia 2010 r., przedstawiono w dodatku.

Dokumenty, o których mowa w art. 14 ust. 1 i 2 rozporządzenia (WE) nr 1005/2008, można przekazywać drogą elektroniczną.

WZAJEMNA POMOC
