Protokół nr 1 do Konwencji o ochronie praw człowieka i podstawowych wolności, sporządzony w Paryżu dnia 20 marca 1952 r. oraz Protokół nr 4 do powyższej konwencji, sporządzony w Strasburgu dnia 16 września 1963 r.
Art. 4
ObowiązujeBrzmienie według tekstu ogłoszonego Dz.U. 1995 nr 36 poz. 175. Późniejszych zmian tego aktu nie znamy.
Zbiorowe wydalanie cudzoziemców jest zabronione. Artykuł 5
1. Każda Wysoka Układająca się Strona może w chwili podpisania bądź ratyfikacji niniejszego protokołu lub w ja - kimkolwiek późniejszym czasie złożyć Sekretarzowi Generalnemu Rady Europy deklarację wskazującą, w jakim stopniu zobowiązuje się do stosowania postanowień niniejszego protokołu na terytoriach wymienionych w tej deklaracji, za których stosunki międzynarodowe odpowiada.
PROTOCOl No. 4 to the Convention for the Protection of Human Rights and Fundamental Freedoms, securing certain rights and freedoms other than those already included in the Convention and in the first Protocol thereto
The Governments signatory hereto, being Members of the Council of Europe,
Being resolved to take steps to ensure the collective enforcement of certain rights and freedoms other than those already included in Section I of the Convention for the Protection of Human Rights and Fundamental Freedoms signed at Rome on 4th November 1950 (hereinafter referred to as " the Convention" ) and in Articles 1 to 3 ot the first Protocol to the Convention , signed at Paris on 20th March 1952.
Have agreed as tollows:
Article 1
No one shall be deprived ot his liberty merely on the ground of inability to tultil a contractual obligation .
Article 2
1. Everyone lawtully within the territory ot a State shall, within that territory, have the right to li berty of movement and freedom to choose his residence .
2. Everyone shall be free to leave any country, including his own .
3. No restrictions shall be placed on the exercise ot these rights other than such as are in accordance with law and are necessary ·in a demoeratie soeiety in the interests ot national seeurity or public sa fet y, tor the maintenance ot ordre public, for the prevention ot erime, tor the proteetion of health or morais, or for the proteetion of the rights and treedoms of others.
4. The rights set torth in paragraph 1 mayaiso be subjeet. in particular areas, to restrictions imposed in aceordance with law and justified by the public interest in a demoeratie society.
Article 3
1. No one shall be expelled, by means either ot an individual or ot a eollective measure, trom the territory ot the State ot whieh he is a national.
2. No one shall be deprived ot the right to enter the territory ot the State ot whieh he is a national.
Article 4
Collective expulsion ot aliens is prohibited.
Article 5
1. Any High Contraeting Party may, at the time of signature or ratifieation ot this Protoeol, or at any time thereafter, communieate to the Secretary General of the Council of Europe a declaration stating the extent to which it undertakes that the provisions ot this Protoeol shall apply to sueh of the territories tor the international relations of whieh it is responsible as are named therein .
2. Każda Wysoka Układająca się Strona , która złożyła deklarację na podstawie ustępu poprzedzającego, może w każdym czasie złożyć kolej ną deklarację modyfikującą treść poprzednich lub wyłączającą stosowanie postanowień niniejszego protokołu na jakimkolwiek terytorium.
3. Deklarację złożoną na podstawie niniejszego artykułu uznaje się za zgodną z artykułem 63 ustęp 1 Konwencji. 4. Terytorium każdego państwa, na którym stosuje się niniejszy protokół na podstawie ratyfikacji bądź przyjęcia przez to państwo, oraz każde terytorium, na którym stosuje się niniejszy protokół na podstawie deklaracji złożonej przez to państwo zgodnie z niniejszym artykułem, uznaje się za terytoria odrębne w świetle odniesień do terytorium państwa, ujętych w artykułach 2 i 3.
